Alicat Scientific Limited Warranty

Alicat Scientific, Inc. (hereafter referred to as “Alicat”) warrants to the original purchaser (hereafter referred to as “Buyer”) that instruments manufactured by Alicat (hereafter referred to as “Product”) shall be free from defects in materials and workmanship for the applicable warranty period defined herein.

Under this Warranty, Products will be repaired or replaced at Alicat’s option, without charge for parts or labor, provided the Product is carried or shipped prepaid to the factory together with proof of purchase.

This Warranty is in lieu of all other relevant warranties, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and any warranty against patent infringement.

Duration of Warranty

Each Product falls into one of the following warranty classifications:

Limited Lifetime Warranty

Alicat flagship Products, including but not limited to M, MC, P, PC, L, LC, and CODA, are covered by a Limited Lifetime Warranty.

This Warranty is conditional upon the Product being returned to Alicat for annual recalibration. Failure of Buyer to return the Product for recalibration on a yearly basis will remove any and all obligations regarding repair or replacement under this Warranty.

Recalibration is considered normal preventative maintenance and shall not be treated as warranty service unless recalibration is required as the direct result of repairs performed pursuant to this Warranty.

Three-Year Limited Warranty

Alicat premier Products, including but not limited to Intrinsically Safe and Fusion Flow, are covered by a Three-Year Limited Warranty from the date of manufacture.

This Warranty is also conditional upon annual recalibration under the same terms outlined above.

One-Year Limited Warranty

Alicat OEM Products, including but not limited to Basis, EP, EPC, EPCD, and custom OEM designs, are covered by a One-Year Limited Warranty from the date of manufacture.

Continued use or possession of a Product after expiration of the applicable warranty period shall constitute conclusive evidence that the Warranty has been fulfilled to the Buyer’s full satisfaction.

Exclusions and Limitations

This Warranty does not apply to any Product that has not been installed, operated, or maintained in accordance with Alicat’s published product operation and installation specifications, whether provided verbally or in writing.

Alicat reserves the right to void any Warranty, written or implied, if upon examination Alicat determines that Product failure resulted in whole or in part from accident, misuse, neglect, abuse, alteration, improper installation, unauthorized repair, or improper testing by Buyer or any agent of Buyer.

Alicat shall not be liable under any circumstances for indirect, special, incidental, or consequential damages arising out of, or in connection with, the sale, performance, or use of the Products covered by this Warranty.

Alicat does not recommend, warrant, or assume responsibility for the use of Products in life support applications or systems.

Obsolescence

If a Product becomes obsolete, Alicat reserves the right, at its sole discretion, to repair the Product using available replacement parts or to upgrade the Product to a current, commercially available version of the original Product. Alicat makes no representation that replacement or upgraded Products will match the appearance, functionality, or operation of the original Product.

Any upgrade may be subject to an upgrade fee as determined by Alicat.

Additional Limitations

Alicat makes no Warranty with respect to experimental, non-standard, or developmental Products. Accessories purchased from Alicat are not covered by this Warranty.

Exclusive Remedy and Technical Advice Disclaimer

The remedies set forth herein constitute the exclusive and sole remedy available to Buyer for any breach of this Warranty to the maximum extent permitted by law.

Alicat’s warranties shall not be enlarged, diminished, or affected by, and no obligation or liability shall arise from, the provision of technical advice in connection with Buyer’s order or use of the Products furnished hereunder.
